Child support has been taken out of my check and the child lives with me? |
My aunt and I agreed to watch over my son while I was away to college in 2005. I wrote a letter saying the child is living in her home temporary until I finish school(trade school only 8 months).She said she needed it to receive assistance for child care and medicaid. I did it not knowing that she used that letter and took to Child support agency. 8 months later(in march 2006 ) I moved to SC in the same home with my aunt and son. I got a job and they were taking money out of my check and it was going to her. I didn't know she said she never was receiving it. I went to the Child support office to report that. I finally got them to stop taking money out of my pay check.(100.00)When I moved and got my own apartment my son still lives with me she was still receiving the money. Am I eligible to get back the money she was receiving while I lived in her home also? The total taken was$2200. I never thought family would do me like this I'm only 21 yrs. old. I thought she was there to help me. Anytime someone goes in and applies for child care and assistance...the agency automatically reports it to the Child Support agency. For example, my husband was paying child support to his ex-wife during their nine month separation. When the divorce was final, he continued to pay child support. His ex-wife went in and applied for state assistance (don't know why she did this for he had medical insurance on the children, he was paying for her house, paying for her vehicle and insurance, and all of her debts.) The ex-wife failed to mention to the agency that he was already paying for child support, hence..they started garnishing his paycheck...making him pay double payments. Of course, over time, she had to pay back what she wasn't entitled to. looks as though your antie committed fraud yes you can sue in small claim court You really need to talk to the court and the child support agency about this fraud... they had no grounds to do this and continue doing this. |
