What do you do when you are injured at a temporary labor job and the company refuses proper workers comp forms


My husband was injured this morning and after he waited 4 1/2 hours IN PAIN sitting in the office waiting for some gal with a big attitude to get him teh proper forms, I gave up and took him to the ER. She had given him a pack of forms which were NOT workers comp related just their personal accident report. When I gave these to the lady at urgent care she said they were nothign to do with workers comp adn he could not be seen as a workers comp patient with them. I went back to the temp place and she said those were the only forms they had and she had no idea whatever else I needed-that it's the ONLY forms they have so apparently they don;t even keep workers comp forms on hand. She also told me that his ER visit(regular hospital) would not be covered.
The hospital is billign his regular health insurance who will refuse it due to the circumstances of it being an on the job incident. He is also now going to be out of work for 3 days from his full time job, prescriptions.....

I just paid out of pocket. What in the world do I do to get this taken care of? I intends to call a lawyer in Workers Comp in the morning as first there was no need in him sitting for 4 1/2 hours waiting on them to figure out what they were supposed to be doing. Second they sure as heck need to be responsible for these bills. What other options do I have?? The hjospital gave me another form for the labor place to fill out, said its all they need for it to be covered, labor refuses.

A lawyer is helpful, but not absolutely necessary in Workers' Comp.

Can you find out who their Workers' Comp insurer is? They can provide the needed claim form.

You can get a claim form from the Workers' Compensation Appeals Board or its equivalent in your state. Then you would file the claim form with the employer.

What state do you live in? That would allow more specific advice.

cripes, talk about passing the buck. They do a fine job don't they. I'm sry that hubby is hurt, and that they are giving him the run around. Guess you need to move to Canada ;)

Call the nearest Department of Labor office. Get a lawyer.

Get a lawyer. They will only charge you if you win your case.
