My employer promised to sponsor me for Green Card and has now withdrawn that offer. I am a Speech Pathologist |
I am licensed in Florida and have my CCCs from ASHA. They have sponsored me for H1b and a week after I returned from London with the Temporary Visa, they called me into the office to tell me that I am not qualifed for Green Card Sponsorship! Are they allowed to do this? The sponsorship of a green card is their decision. As you are on a renewal H visa you will have to the end of that visa and then you will have to leave the US. However they are responsible for getting you and your belongings back to the UK (I assume you are from the UK) This is part of the H1B paperwork that they sign. well i guess when they told you that they would sponsor you they thought you would b quilfied for the green card. If they say that you are not qualifed for it then maybe they are not allowed to sponsor you Yes they are allowed to withdraw the petition at any point in the process. If they are saying you are not qualified for a greencard then there must be an underlying reason a to why. For example if you ever entered the US illegally stayed for at least 180 days and then left. Or if you overstayed any previous visa and then left. Do you have a written agreement? Yes. This country has ten to twenty schools that graduate dozens of Speech Pathologists every year. Most of them cannot find jobs. Employers are taking advantage of the H1B's to hire people who will effectively break the demand for wage increases and I would guess.. you are one of those that types in terms of your employer. That doesn't make sense when there are a dozen more pathologists out there trying for that very job. (None of it makes sense in most cases.) They are allowed to do anything they want, only hope you have it in writing that they would sponsor you for green card. They may have to pay you more if you have a green card and I guess they don't want to, case of foot in the mouth disease |
