Burden of Proof ??

Hi,
Can someone shed some light on whose burden proof of delivery of a product falls on ? Currently disputing a credit card charge for merchandise which was canceled due to numerous rescheduled deliveries and ultimately canceled the order.

Have filed complaints w/ the BBB and Attorney Generals office
as credit card company has now reversed temporary credit for
dispute claiming merchant has stated that product was delivered.

Question is, is the burden of proof of delivery (non-delivery in my case) on the merchant or the consumer ?

The delivery company should have a way to track what has been shipped and delivered. If you have not signed for anything, the proof is on them.

If you didn't sign for it, it should be on the seller.
