Canadian marrying American?

I have a few questions about getting married and staying in the states. But, first I'll give you some details. I'm canadian. I entered the US as a tourist and did not recieve an arrival or depature slip when I crossed over the border. As a canadian I can stay up to 6mths. My 6mths are up at the end of this month. However, I am engaged to a wonderful man whom I intend to marry next weekend. I know I waited to long and now I'm becoming a bit concerned. As long as I get my perm. or temp resident form submitted to the processing office before my 6mths is up, I should be fine, right? Is there any law that says I won't be allowed to stay and have to return, even after we have married? Does not having an arrival or depature slip affect my application for perm. or temporary residency?

There is always a risk. Just recently I did read of a Canadian woman who was denied her adjustment of status as she was unable to show that she didn't have have immigrant intent, nor was she able to show that she was inspected and granted entry. Many have also successfully adjusted status in the US after marriage to a USC. It all depends on your circumstances. Best advice is to seek a consult with a competent immigration attorney who will be able to advise you based on all your circumstances.

Canadian huh, better be careful marrying these Americans, especially if they are women. They sure are no good.

why would you want to come to the states, we still have slavery, (its just legalized), when they say We the people, For the people By the people, they mean just that, for them,not u nor me, so stay there, and let me know if there are some availability in your complex...lol

If you want the best advice- listen to Aussiewench. Several months ago she put me on the right path to everything I needed to know. I too am Canadian and married to an American.

After you marry, your husband can file an I-130 and I-485 at the same time, both petitioning for you and requesting an adjustment of status. The fact that you entered without inspection, however, will weigh heavily against you unless you can convince USCIS that it was normal at that particular border crossing post to simply allow obvious Canadians to enter without any formalities. If you can't do that, they might deny the adjustment of status and require that you apply for your immigrant visa at a US embassy or consulate in Canada. Then you would have the same burden of proof of your legal entry, but before a US consular officer.
