Social Security Disability Child Allowance.....what does it count as in court?

I got temporary disability and my exwife got the child allowance. Due to my injury I got behind on child support. When she got the check from the Social Security Office I called DHR, they say that the lump sum check she got did not count as child support. So now I have to pay the arrears out of my check, and she gets a free $9500 check. Is this normal or is there anything I can do? I am in Germany in with my wife who is in the military so flying home to dispute this is finacially difficult at the moment. Is there anyone I can turn to for help on resolving this?

Out of curiosity do you have to pay alimony too? The only time that your check should have been seized is if you had become behind on your child support/alimony support. I know that my ex-husband got behind on his child support. He then filed his taxes and due to the fact that child support had a lein on his name when his tax return came due it was automatically sent to me via the child support system. I do know of one man who had his tax return seized and sent to his ex-wife, yet he did not owe any child support. He sent copies of his up to date payments to the child support office that was handling his case, they had to reiemburse him. To bad his ex had already spent the money, she in return had to pay the child support office back.
So If I was you I would again contact the office that is handling your child support order, ask them again if you were in arrears and if so how much? Ask them for printouts of all payments that were recieved by them from you.
I hope that you kept all reciepts showing when your child support was paid.
Also if you were paying her DIRECTLY and not to the child support office and she did not notify them of the payments you will have to prove that is what you did. You will need money order #'s and canceled checks as proof.
Also in your divorce, did she have a claim for money that the judge granted her from you? Alimony, bills that she claimed she paid,but were for you? Please check your divorce decree to see if this is why the $9500 check was taken from you. Did you have to pay for the child's medical care when she/he was born? Again if this was in the divorcee decree and the judge granted this, again this could be a reason why this money was seized and given to her.
