Are A Company Obliged To Tell You Before You Connect To Them That They Will Be Recording Your Telephone Call?

Or Just By Advising You On The Website That Some Telephone Calls May Be Recorded For Training Or Reference Purposes,I'm Confused!! I Would Think That They Would Have To Advise Before You Connect But I Dont Know!!! Does Anyone Know The Answer??

It would be hard to tell you before you contact them. What if you didnt see the website first?

So then it would be nice for them to say originally upon first answering, to give the usual recording about possibly recording your call. But they don't. Only certain reasons will they record or give the message.

But they are indeed supposed to let you know your call may be monitored or recorded. It's the law.
But then, we all know that everyone obeys the law.......

I believe it depends on the state, here in CA, you are to be warned that calls are recorded for quality assurance and training purposes.for the most part yes. you should be told before the connect, otherwise its illegal.

the laws for recording telephone calls vary from state to state.. and while you are in the UK, i would assume that recording of calls there would be similar, where it would depend on local laws...

in NY to record a telephone conversation you are only required to have permission of one party of the conversation.. so if you are recording your own phone call, you would not need anyone elses permission to record... however, some states require everyone involved in the conversation to be aware that they are being recorded... so pretty much every business that records or monitors phone calls advises you at the beginning of the call with a recorded message, incase you are calling from a state that requires both parties to consent to the recording...

a company that records or monitors calls, and dosent make this disclosure... i wouldnt be too trusting of them... even in areas that dont require both partys consent...

If this company is taking calls from across the country (probably are) then they would be advised to post the warning.

There are 12 states that have laws prohibiting recording unless both parties consent. So if they were to record a call from Michigan (for example) and didn't post the notice, they are in violation of the law.
