Opinion reagarding the recording of tel. conversations w/o indiv. being aware of this fact?

Many of the modern answering machines have the capability of recording telephone conversations without the callers knowledge. What is your opinion regarding the recording of telephone conversations without both individuals being aware of this fact.

I believe the recording of a telephone conversation without the full knowledge and consent of all parties is illegal unless you have a court order. To do so could risk legal action.

You don't say where you live. In the United States it is definitely illegal to record a phone call without a person's consent, implied or otherwise. (unless you're the FBI, lol ). If you are concerned that you said something....ummm.... not nice....no worries, it can't be used to prosecute you! If, on the other hand, you have something recorded that you want to use against someone, ya can't do it! (At least not in a legal sense). That's why they have those cute little recorded messages.... "this call may be monitored for quality and training purposes". A person has to be notified that the call is recorded.
Now, if you make a call and the answering machine picks up, and a second later, the person picks up....chances are real good the conversation is being recorded! Not sure how that would play legally. When you call and get an answering machine, it's not like you don't know it will be recorded.........

Law states that for evidence used IN COURT one party must consent in a taped conversation. If you are taping, you gave the consent.

You have the right to record every conversation you have with other people. It's proof of what you are saying.

Recording two other people talking, without their consent, may be illegal. At least if being used for evidence in court.

My friend recorded his probation officer lying to him and recorded it on his answering machine. When you get harassing phone calls, it will definitely help you in court when you have evidence of it. Not only will there be phone records of the time and date, but the actual recording of the offensive behavior.
