My employers are trying to hold an investegatory meeting about me while i'm on the sick?

I'm currently off work on long term sick, and have just been signed off again for 2 weeks for stress and a recent bereavement. My current employers have had to postpone an investgatory meeting (involving HR and my Manager) regarding my work but now they are saying that they are going ahead with the meeting even though I'm still off sick. They have asked me to attend the meeting even though I have told them I'm not fit to. They have now asked me to provide either written documentation to answers they are asking for or for me to be included in a telephone conference on the day. What can I do about this as its really stressing me out? Also I really want to make a complaint regarding my Manager should i pursue this ahead now I know of this?

Hire a lawyer.

Yes start your complaint now before they cut in before you because if you do it after it will look like you are retaliating to their meeting, seek some professional advice now and don't delay good luck babes :)

So, what's your problem here? Your employers have the right to hold a meeting regarding your employment with them, and the right to ask you to attend. They have the right to hold the meeting when they want to, and to ask for written documentation that would support such things as your being off for an extended period of time. It's too bad it's stressing you out, but it sounds as though you may have been taking off excessive time or not performing well at work when you are there, thus your employer wants to get to the bottom of it. I really don't think this would be an appropriate time to lodge a complaint against your Manager. It sounds as though you are already on thin ice. I would secure legal support and attempt to pull yourself together and meet with your employer. Not doing so will undoubtedly mean the end of your job there. You may be fired anyway, but I would at least be up front with your employer. He or she is calling the shots on this one for the most part, not you.

yes... I would and also hire a lawyer

While I extend my condolences for your loss, this sounds to me like we're not getting the whole story here. If HR and your manager are attempting to resolve the situation and inviting you to participate, and you continue to avoid doing so, that appears to me to be an employee who has a vested interest in continuing to sit at home and collect disability/sick payments. If you were unhappy with your manager, why is it that you only decided to complain after you were asked to participate in this meeting?

Here's what I think - you have found a doctor who will write you a note to keep you off of work for whatever your complaint of the week is. Your employer is trying to either bring you back to work, or to terminate your employment. You don't want to be terminated because you would lose out on certain benefits, but you don't really want to go back to work, either. So, you are playing an extended game of dodge 'em with your employer - submitting a new doctor's excuse every few weeks, refusing to participate in meetings to resolve the situation, filing a complaint as a smokescreen.

If you don't want to be there, quit. If you want the job, figure out how to get better and return to work. Either way, quit playing games.
