What should i do when someone hits me from back and accepts to pay the damages?


The guy hit me from back 100% his fault accepted to pay the damages signs a paper saying that he will pay I got his insurance number, plate number name and telephone number.I got estimates for the damages but now Everytime I try to call the gu he refuse to answer my calls.What should i do?Please help me.Even thou its not my fault if i report it will it change my insurance?What are my rights?

I have been in the same situation...If you have the other person's insurance information...call the other person's insurance company...I did not trust that person to call & report it so I did. The insurance company took care of everything!! It should not affect your insurance at all if you have all the documentation that you have. Keep copies of EVERYTHING!!!

You said you got his insurance number. Use it. You really have no reason to talk to him if you have the insurance companies number.

Why would an accident that is NOT your fault where your insurance doesn't have to pay out affect your rates? Call your insurance and make the report, make sure they see where he signed accepting full blame. They will contact his insurance and you will get your car fixed.

Just go to the insurance company. It was not your fault and you will not be penalized for it. But he will after his insurance goes up for not reporting or paying. You will get the car fixed by the insurance company along with any medical bills for injuries.

I expect he convinced you to not call the police and file a report. Bad move on your part if that's the case. Just turn all the information over to your insurance and let them go after him.

If the statement wasn't notorized it most likely will not hold up in court. Send him a registered letter through the post office with an itemized statement of damages and ask him to remit within 30 days or contact you at your phone number. If he fails to make sure you have documentation of your attempt and take him to small claims court or have a lawyer send him a nasty little letter. Since you didn't contact the local authorities and get an actual accident report it might be hard to recover if you don't have witnesses. Depending on how long it has been since the accident and your state laws it might also be possible to file a personal accident report with your police dept to serve as additional documentation.

just go and talk to your insurance company they cant do or say anything with out your consent but ask in the form of a question like it happened to a friend but you should have call your insurance as soon as it happened

since he is not cooperating, you have no choice but move on;

1; call his insurance company and file a claim; since this is a rear ender, they will pay for your damages;

2; if they cant confirm he has insurance, then call your company and report this; if you do not have collision or uninsured coverage, your company will do nothing;

3; if the above 2 fail, do as the other stated, certified letter, copy of damages etc so that you can file a small claim suit; but with small claims, that could take 6 months to a year to be heard; that is the reason you want his or your insurance company to get involved, since it would be settled in couple of weeks;

Always report accident to your insurance company giving them all the details including a little sketch the the 2 cars before and after the accident, include such details as to width of road (Approx) Speed, any reason for you stopping prior to the bump (Traffic lights, stop lines etc).
Time of day, lighting conditions dark sunny foggy etc. Were light on, and any name and address of witnesses if you have any, and any other details you feel may be relevant. Do not forget to send a photocopy of the paper he signed. (Not the origional)
Then let them do the job that you pay them for.
They will contact other persons insurance.

If you are hit from the rear it is automatically their fault for not keeping their distance

report it HURRY!! This is what they do. Tell you not to worry and they scurry down to DMV and make a report before you even know what happened. They will put you at fault. Go there immediately and make a report. Forget your insurance. If you do not make a repoprt, that will be an even greater problem
