Can discovery phase start prior to scheculing conference if local rules of court state otherwise?

I filed a civil action and would like to start discovery but local rules of court state that until the court orders a scheduling conference no discovery can start.
Can I request discovery prior to the court's scheduling a conference?
I have completed the complaint answer phase an am on day 115 of this action.
Local rules of court reads that the court on or before day 90 will schedule, but to date, and I confirmed this via telephone to the clerk of the court, that no action has been initiated.
Would it be improper to request that I be allowed to start discovery?

What jurisdiction?

what state are you in? Couldn't tell you without reading into the rules of court for your county
