What can you do if a collection agency screws you, do we have rights?

I had a bill and I set up payment arrangements for 6 months with this collection agency. I paid on time every month $164.00. The agreement was that I would call and do a telephone transaction with this payment for 4 months.

The last payment i called 8 times and no answer (even thought the letter they sent me said they were open 24hrs). The next day they tell me they have referred me to another collection agency for $800 dollars because i did not make my last payment. THEY SCREWED ME!!!!!!
I have the telephone calls that I made on my cellular bill as proof that i tried to make this last payment.
Can i do anything, or can some agency help me?

They'll just deny everything. I don't think there is anything that you can do.

You don't NEED to do anything. The agency's activities cannot change the balance you owe by as much as a penny. You can simply pay the balance owed to the new agency, and if they aren't satisfied, tell them to get lost. Pay by check, and save your cancelled checks. One of my greatest pleasures in life is telling a collection agency to f--k off; if they do not strictly follow the rules, you can stick them for thousands of dollars in damages.

This is probably what you don't want to hear but YOU made several mistakes. You should NEVER talk to a collection agency over the phone but only through Certified Mail. So that you have a paper trail. Without something in writing what proof do you have that that $164 for 6 months was going to pay off your debt. If you only had 2? payments left($328) and still owe $800 I have a feeling that this is the case that you were not going to be done in 6 months. It is hard to believe that a collection agency said that they were open 24 hours a day. But even if they did it probably would not change anything, as there is nothing that says they are not allowed to sell your account.

Since you have paid on this account, you may have lost a lot of leverage. So you need to do the following. Send the new collection agency an offer in writing saying you will pay the remaining balance(that you thought) of $328. Also, that once you do they need to remove their collection account from your report. Also state that they are to only contact you by mail. DO NOT sign the letter, just use your typed name. DO NOT send any money. Send this by certified mail. If they send you an agreement in writing you can accept then follow through and make through they follow through with their end.

No seriously. You can fight it, and you may even win...but it will be time consuming and painful. Collectors are spawns of hell.
