Waiting for claim for an accident a year and a half ago.?


A friend, who was also in the accident, contacted her solicitor and details of the accident were submitted.I had to leave the country a few days later so I never had any direct cotact with the solicitor but was present during telephone calls and my details were given to him.After around 8 months with no contact I emailed the solicitor and got no reply.I then called and was told not to worry-everything was moving along.Then I heard nothing so a year after the accident when I was back in the country I made contact and was told that it should be sorted by December.He also wanted to make an appointment for me at a chiropractors and said he would call me ASAP since my time at home was limited.I never got the call and had to leave the country again.I have emailed him again-heard nothing and called him-no answer.I worry that he is just stringing me along because I never met him in person and never signed anything handing the case over to him.Am I right to be suspicious?What should I do?Thanks

The average time for a claim of this type is about 3 years but you would be advised to see this solicitor even if it means not going abroad for a while ,as it does sound a little bit suspect..

it took me two and half years and seven operations before my claim could be sorted, my only advice is see and speak with your solicitor face to face, make sure you are kept up to speed, you will win in the end,

The length of time it takes to process a claim from date of the accident is dependent on a whole host of factors.
It may be that the injuries have no resolved, I may be the other side are raising queries it may be a million and one things.
However, youa re the client, and you therefore ought to be made aware what is happening at any given moment, and if it's not hapening, why not.
There may be a perfectly simple explanation for the delay. Or it may be obfuscation. I'd forget email. Write to the solictor asking the following easy to answer questions:
1. has liability been admitted?
2. Has quantum been agreed?
2a. Have any offers been made eitehr way?
3. Have proceedings been issued?
4. precisely what stage in the litigation process has this claim reached?
5. What further evidence are you waiting for?
6. Is it anticipated I need to see an expert for the purposes of a report? if so, what type of expert and when is this likley to take place?
7. When do you anticipate this matter will be resolved?
8. What is the next step in the process and when will this be taken?
9. What is the best way to contact you and within what timeframe can I expect my queries to be dealt with?

The answwers should give you a pretty good idea whether your solictor is worth sticking with, ot not.
