What are my husband's legal options?


My husband was recruited by his present employer 17 years ago. Recently, a female subordinate accused him of sexual harassment, but not to his face--& totally unfounded. She sent a letter of complaint to his HQ; they called him & asked him to relocate back to the HQ office from the field.

He did not want to relocate us and our 3 children. He asked for letters of support from other female subordinate staff members; he received 14 letters of support.

Currently, this female who complained has resigned (not due to my husnand)--so she is no longer with the agency. The HQ office refuses to share the details of her letter of complaint with my husband, so we are not sure what this is about exactly. And the HQ still wants us to relocate.

This means I have had to quit my job. We will have to buy a house in the US (we are overseas). Our children will have to change schools, etc.

My husband is 5 yrs away from retirement. Does he have the right to sue?

Speak with a lawyer. Your husband does have a right to defend himself but that is here in the US.

Also we don't know the country in which you are in so the laws there are different from those in the US.

I would think they would have to do an investigation of the allegations before they ask you to move. Who knows they could of settled with her and in returned asked her to leave the company. I would consult a US attorney and ask for their advice. That's messed up that this happened to you all.

The company has no legal responsibility to keep your husband in the same location or country. He can quit if he doesn't want to move.

For all you know, they might want to downsize at your location and are using this as an excuse.

Your husband needs to start finding out what moving policies are and also try to network with the people he has worked for 17 years. They might have extra benefits for people in the position of having been in one location and who want to stay.

All things considered it seems as if the company is making a decision based on bad information. If ther company have a legal department I would request that they might be able to help.

There are some laws that protect against unjust firing which I assume is why he wasn't fired. There are no laws that I have ever heard about that restrict where a company can move a particular job or employee.

I would try to work within the organizat5ion to see if there any other options available. I wouldn't try to make the harrassment an issue . If all of your focus is on the harrassment and it turns out there was another reason for the transfer you might be limiting the options available.

If the company paid off the one who complained in return for her leaving ( which they might have done) your husband has already been judged guilty .
