Someone Filled Order of Protection on me but calls and texts still?


Okay heres my situation an order of protection was filled against me to stay away from their work, home (which I own also) and relatives. I was served the papers yesterday about a week after it was filled. Now the problem is this girl is not only sending me text messages about they would like to talk it out but requesting for me to call them or see them.

I recently got a text message saying I have mail ( at the home I own) and I can come by there office to pick it up by the end of the week or they will throw my mail away. Now my order which is BS in itself says they request no contact from me whatsoever but they keep trying to contact me!!

My question is can this person be charged with anything If I can prove not only they are calling me after this order, texting me from the same phone # they put on the order and also threating to throw my mail away that they know I cannot get from my house we share because they know I cannot legally go over there?

I also wanna add there is a court date in about two weeks, she checked off for the part that says have hearing to have order extending for up to one year....

Isnt it against the law to throw my mail away though? and if there is the court date in two weeks should I just wait until then to display all the proof of her contacting me repeatdly and asking me to literally come by her to pick up mail.

Go to the post office and change your mailing address.

If so, then she is in violation and you should talk to the DA about it. She is trying to entrap you and the DA needs to know this, too - it may vacate her order or you can have one put on her, too.

Yes, you can and WILL be charged if you violate the Order of Protection. Law Enforcement must abide by it and have no opinion in the matter. Go to the post office and have your mail forwarded to you. Do NOT respond to this person by phone or text and only allow a 3rd party to do it. The person who filed the Order of Protection cannot be charged with anything unless the Order states such or they violate a law.

Save your texts and messages - go talk to the DA that issued the order and tell them you want the other party to have a restriction from contacting you too - if they are basically inviting you to break the order, you need to inform the authorities in case you get in trouble one day. DON'T go over there or call back or text back. Let the authorities know where they can leave your mail so you can pick it up (mutual friend, etc.) DON'T tell them - tell the authorities where to have it dropped off.

Everyone pretty much has the same idea I have. You legally cannot go over there, so don't. Get your mail forwarded at the post office. There's a simple form that takes 3 minutes to fill out. Then, any mail that arrives with a yellow forwarding sticker on it -- contact that business and change your address.
