What are my legal rights when my roommate of 5 mos who is the lease holder wants me out?


we were friends for a while first, then her current living situation was bad (two guys) and she wanted to get out, we decided to move in together. I have the complete furnishings of a large one bedroom apt which i agreed to share of course and she had no money to lay out for all the move in fees, security dep, pro rated 1st mo rent etc...a total of $1220.74 which I paid for to help us move in. Unfortunately, I couldn't be on the lease due to a felony charge from years ago. Palm Beach County Florida is pretty strict! anyway we haven't been getting along and she has a new boyfriend and wants me out. She told me today that she got a notice from the leasing office that all tenants living in the apt has to apply to be on the lease or vacate within 7 days!!!! she didnt show me this paper. I don't know what to do...I have no where to go and there is now way I can move all this stuff in 7 days....Are there any loop holes that I should know about? I need help fast please!!!

i found out that its not that i have 7 days to move out i have 7 days to apply to be put on the lease and if i don't i will have to vacate. My roommate knows even if i spend the $50 to apply I won't be approved. That is why initially I wasn't on the lease. And the only reason why we are in this apt is all because of me and my efforts to find it and my money.
She never had anything in her name and has moved many many times. The rental mgr (whom I know as an aquaintance) of this complex knew from the geico I was roommating with her and helped me to keep my name off the lease ten we would have a greater chance in being approved. Every month I have been writing a personal check for my half of the rent and nothing has been said. She has the nerve to ask me for my half this month and of course i will not pay a thing now since I know she wants me out. She owes me a lot of money $1220.74 and I want it back!

She, or the landlord, will have to formally evict you. She probably doesn't have much leg to stand on as long as you pay the rent. The landlord can require your name to be listed as an occupant. He can probably also require you to be added to the lease but if he refuses you on the lease there's probably not a lot he can do to evict you.

The only way you can be evicted is through the courts. At any rate, you cannot be put out in 7 days by anyone.

I really would suggest a consultation with a local attorney though. You really do need legal advice and you can't get that here, even from an attorney.

Lease or no lease they must give you 30 days written notice, but since you are not on the lease you will have to be out in the 30 days.

this does not sound like someone i would want to live with. decide what amount of $ you think she should give you and also a reasonable amount of time and discuss this with her. then make plans to move out. good luck to you.

She allowed you to move in that means you are a tenant and get treated like one she has to serve you with a 30 day notice and since you already know what is going on with her I would not pay towards anymore bills etc. and I would move my stuff as soon as I could. Also tell her you need your deposit back since she didnt pay anything towards it I hope you have proof that you are indeed the one who paid it maybe you can sue her in small claims. Make sure you take plenty of pictures once you do move so she cant say you damaged something.

No way! No one can make you move without a 30 day notice. That is so mean of her to put you on the spot like that. Still, no matter what, you have at least 30 days. Also, if you are not in default, I don't think she can make you move at all. It's not that easy to evict someone and you need a really good reason. Usually you can't evict someone unless they haven't paid you. And I don't believe that story about the landlord. Why don't you call the legal aid society and find out your rights. Don't worry, though. I'm almost 100% sure you don't have to leave in 7 days, if at all. I'm sorry for the stress
