I'm strongly condersing filing a lawsuit...?

against my high school:

Basically I'm sitting in class and a security gaurd walks in, interrupting my teacher's lecture announcing that I have to come with her and take my belongings with me. She makes it quite clear to the class that I am in "trouble" by her side comments. I'm escorted to someone in administration's office who begins interrogating me about my whereabouts during a specific time of day as well as if I was in a confrontation with another student. I told him where I was, that I hadn't even spoken to anyone else and showed me a picture of the boy, someone who I had seen but never spoken to before. I later learned that there was a big fight, I shared the same first name as the antagonist and was black like him.

Well from what you said the guard acted like any under educated over worked empowered cop wanna be would act in a similar situation where an assault took place and they get to possibly be a hero for a day by catching the culprit. The fact that you are an A+ scholar, magazine editor, accomplished musician, and top tennis player, more educated than probably 95 % of the students in the school didn't come into play but the fact that you were the same skin color and had the same first name as the antagonist did. Since you didn't suffer any physical abuse or pain I don't think that you have any grounds upon which to base a suit. As for embarrassment most of your class will probably look up to you as a potential badazz now. Sorry that you had to go through that kid but like the saying goes Shithappens.

You were not "racially profiled." Your name & appearance are similar to the suspect. That's called "a description of the suspect" not "let's target the black kid for no reason." Good grief.

You would have a hard time proving damages, and proving that it was any kind of racial profiling. If a perpetrator was black and you had the same first name, this would probably lead them to questioning you.

It is unfortunate that this happened to you, and does show how false allegations can arise.

You don't have a case, a mistake was made. Did you have to go to counseling to help you through this tough emotional time? Can you prove your reputation was damaged?

You have no legal basis for any such thing.

The school has the right to do everything they did. The school must maintain dicipline and order. They did nothing out of the ordinary.

You can not lead a happy & productive life if you are unable to overcome such insignificant events like this.

Not every negative event that happens to you rises to a court action. Our judicial system has limited resources and should be used for very important matters and not such nonsense as this.

I think you should discuss this with your parents and hopefully they will be able to explain this to you as well.

And now you expect us to back you up on that? Did you even bother to ask how the other kid was doing, or is this just all about you?

Well, that is pretty bad, you'll probably be able to get it into court, but about winning the case, it won't be considered a traumatic case, especially with you being a teen and having other drama in your life.

Also on the racial profiling, two things: 1. You'll have a hell of a time proving that it was racial profiling because ultimately it will come down to whether you look like the antagonist (a judgement call at best) 2. That if your school was racist like that, you'd probably run into the same thing with a judge/ school board (definitely more with the ladder) I feel bad for you though. If there was a BLACK assailant with a similar name as you who got in a fight, then their singling you out was NOT racial profiling. It sucks that you were embarrassed like that, but you don't have a case. I wouldn't waste my money.

Well, if you have the same first name as who they are looking for that is not racial profiling that is just a case of mistaken identity. Now they should not treat like you are guilty until you are proven so. They should treat you with dignity and respect. As far as being embarrassed for being pulled out of class you'll just have to get over that because I'm sure no one else is thinking about it. Obviously it sounds like the confusion was cleared up I don't think you have a lawsuit unless you were mistreated physically or you have other damages.
