Can the attorneys for my HOA put a lien on my house even though I'm caught up on my HOA payments?

I've lived in my house for 11 years - I've never missed a payment - always paid on time. Last year I got married and moved out of my house (which is rented). My son also moved out and moved into his own condo. I changed my address witht the post-office but the mail has been getting screwed up because my son and I shared the same last name until I got married. Because of my move and wedding I missed three payments. The attorney's sent me a certified letter to my son's address saying that they are puttng a lien on my house. I have paid the past due amounts to the HOA and explained that my mail has been going everywhere but to my new address. The attorneys don't care. Even though my HOA dues are paid they're still saying that they are going to put a lien on my property of I do not pay them their fees of $229. Can they take my house away from me or can I fight this?

Put your explanation is writing and then send it to the attorney's office by certified mail with a copy of your paid HOA dues receipt. Also, if you have a copy of the envelope you received the notice in that shows the post office forwarded it to the wrong address that would help.

Also, go to the post office and get your correct address listed as your current address to avoid this mess in the future. Be sure to talk to a human - don't do this over the phone or the internet.

Attorneys have a job to do and that is to make money for themselves. They sent you a letter and that took their time. They probably usually bill $200 per hour and that was an hour of their time plus expenses.

Talk to your HOA and see if they'll call off their pitbulls - but chances are you're liable for the attorney fees.

They can't take your house away - they can just put a lien on your house for their fees and you can't sell the house until you pay their fees (amount of the lien).

Pay up and get your mail straightened out. If you weren't getting your HOA bills, you should have realized it.

You missed three payments - therefore you are liable for Late Charges and/or interest plus Legal Fees. I suggest you pay the $229 before it gets even larger.
