I fellow server stole tip money from me and boss hasn't helped me?


i work as a sever and we don't share tips. u wait on your tables i wait on my tables u keep all yours and visa versa. well 3 months ago a guest called me over and informed me that her and her guest seen another server steal/take my tip money off my table. i got a manager who went to the guest and the guest also provided a written statement. its been 3 months and everytime i ask my gen. manager he blows me off. i work at a corporate own chain. what are my rights? i know my boss did not report it our corp office for investigation because he pretty much said 2 me theres no real proof. its the guests word against hers. my gen manager never even spoke to/interviewed/questioned/callled the guests or the manager on duty that day. i been there 10 years. now what? who is he to play judge? she stole period.

The guests were willing to give a written statement that they saw another employee STEAL. Your boss doing nothing about this is either a coward or in collusion with that employee. If this person would steal from you they'd steal from the company. You have to wonder why the boss hasn't done something to get this person out of the job.

Many corporations have a grievance procedure where you can escalate issues. You should contact corporate human resources to find out. Just be prepared for negative reaction by your boss. The chances they'll fire him/her over this is very slim so your life could become very difficult even if they have rules prohibiting firing you or otherwise punishing you for filing a grievance. Many corporations fear getting sued though and the fact you felt strongly enough to file a grievance may make them very keen on helping you and preventing retaliation.

It would be very helpful in filing such a grievance if you had a copy of what the guests wrote and/or knew how to contact them to prove this.

Also be sure this is "the corporation" you work for - many restaurant "chains" actually franchise out so the company you work for may be a local franchise comprised of just your restaurant. There are large franchising companies out there that own many restaurants so they will have policies similar to the chain corporation.

You have to decide if it is worth it.

Was the amount of the tip worth elevating it to the next level.

OR... to start looking for employment elsewhere if you don't want to work with a thief.

Generally, upper management won't get involved in a "he said - she said", situation. Without an instant replay from a security tape, I would say you are out of luck.

It might even backfire on you by virtue of your getting the guests involved in a money/dishonesty issue. Most businesses like to keep all that internal.

if it was a lot of money for the tip, then call a lawyer or something cause you deserve that money and its unfair that the person stole it. but, if it was only like $5, then does it rly matter?

There's nothing you can do, as someone who works in a corperate 'raunt, chances are the GM doesn't give a damn about something so small no matter how long you've been there. It's like he said, your word against hers. Approach the server yourself and do things your way.

let it go, but kick that servers butt. NO, dont do that, just watch your tables and let that server know you are watching them. Write a letter to the company owner, that you are unjustly unprotected on the job and would like the situation remedied. (you want the server to pay you the stolen tip and the manager to back you up!)

if it was less than $20 she stole, u cant do nothing legal about it.

Gather all the information you have approach your manager again if nothing happens I would contact my corporate office directly. But be prepared for some repercussions.

How much of a tip was it that you're carrying such a grudge?

He's right though - there's really nothing he can do at this point, and there's nothing you can do either. Unless someone tipped you a hundred or a thousand dollars, let the $2 go and get on with your life. Three months is a long time to carry such a grudge over nothing.....

Nothing will come of it unless the manager actually witnesses it himself. I worked in the industry and it sucks. I have several scenarios where someone took my money... I was proactive. I asked the person (happened to be a busser) and they denied it. Then magically it appeared on the table again about five minutes later. If you are CERTAIN about who did it, spread the word to your fellow servers... but only if you see it happen or can trust the person who tells you it happens. That way you guys can watch each others tables and collect money for each other so it will be less likely to happen.

I am sorry for you... try to keep a better eye on your tables or work out a system with a friend.

By the way - this is not legal advice.

First you need to talk to a lawyer it doesn't matter if it was five dollars or ten. You need to sue the company for negligence to rectify the situation and get your money back.
