What are our legal rights when it comes to another person cashing a check with the same name? |
My husband happens to share the same first and last name as someone who just happened to grow up in the same town as him. We no longer live in that town, but he does. Evidentally, he received an insurance check in the mail that was supposed to be for my husband. The insurance company had our old address and the post office must have just saw the name and put it in his mailbox. Well, he cashed it and the insurance company is going to send my husband the canceled check (to the correct address this time) so that he can prove it wasn't his signature. Other than contacting the police for fraud, what else can we do legally to get this taken care of? This guys a piece of garbage for cashing that check ! I'd do watever it takes legally and if that doesn't work,,,,, I'd take it out of his HIDE !!!!! That's it. Good luck Find out where that guy banks and withdraw all of his money. It doesnt matter. 2 times I've had or known someone who had checks stolen. The cops would not do a thing about it, even though in one case the person confessed. They were too busy pulling people over for minor traffic violations. |
