I work at this check cashing place, Recently money came up missing.?


My question is, if it is legal for my employer to make me pay the amount that is missing, But keep in mind I have two other co-workers who share my office, but not the same register, they came up missing with the same amount? Should I pay, or find myself a lawer?

Depends on how badly you want the job. Under the law (both state & federal) wages cannot be attached or garnished without a legal court order.

In other words, an employer may NOT arbitrarily retain any wages due to an employee due to damage or misappropriation, nor may an employee be terminated for refusal to comply with such a demand.

Now... the employer CAN terminate you for other causes, even though you may know that it's for this particular reason. You could sue for wrongful termination, but a lawyer to file such a suit costs a lot of money. Is the amount you're disputing worth it? And would you want to continue working for such a hostile employer?

They also offer Compliance Assistance in cases where employers are violating the law. The DoL website also offers links to state laws in various states that may provide more employee protection, as well.

Bottom line is, I would not pay. I've found that many employers simply rely upon the employee's lack of knowledge in the law to coerce payment. Still, as I said, he could let you go for 'other reasons'.

If its missing from your register then yes your employer has a right to hold you responsible and demand restitution.

Depends how much was missing. If it's small potatoes, you'll end up fighting it more.

As far as I'm concerned, they owe you the wages and then they need to take you to court if they want you to pay them anything.

They cannot "make" you pay, but they can certainly make your continued employment conditional on payment.

Get yourself a lawyer. You could be looking at charges for felony embezzlement. You also should not admit to any wrongdoing if you are innocent because it will haunt you.
