Hostile and or Uncomftorable work environment?


I am a man that has to share a small office space with three other women. Two of these women are extremelly disruptive, loud, and at times vulgar. They talk about there personal and sexual relationships openly. Talk down about men(one is a recent divorcee) about how all men are evil. I believe one is even bi-polar cause she is always either extremelly happy and yelling or sad and crying. I have asked on several occasions to be moved to a seperate office. I have complained to my supervisor and my union steward.
Do I have any recourse to force the company to move me or anything? Or even any legal recourse?

You actually claim several instances that fall under the rules of sexual harassment, which includes a broad provision for "hostile environment", meaning if you are subject to conversations that are insulting or repulsive in nature relating to anything remotely tied to sexual behavior (including a dirty joke!!).

Everyone believes sexual harassment is limited to the forced exchange of sexual advances/favors for employment purposes. Not the case at all, it's an extremely broad law that easily encompasses your example.

Document it and ask for a follow up in 2 weeks. That will get them to put a end to this.

The solution depends entirely on the options as outlined in your union's collective bargaining agreement.

IF your agreement allows for grievances within a particular structure, you must first avail yourself of that process. If you do, and the behavior continues do the following:

Send a certified (RRR) letter of complaint to your shop steward and the corporate HR representative with CC copies to your state EEOC.

Advise them that this is your final request to have such behavior stopped and that you expect that the issue will be addressed as it is affecting your work and is unprofessional.

IF nothing changes, then file a complaint with the state EEOC referencing your letter (with a copy).

IF the EEOC decides (after investigation) that a hostile workplace does in fact exist, they will issue a 'right to sue' letter. When (or if) you have such, you can seek the advice of a local employment rights attorney.

File a harassment charge against them. Go to your union official and tell them you want to file a grievance against them to get.

I'd bet they'd find a different location for you to work out of then.

When you ask to move and make complaints what do they tell you? Maybe if you just have a talk with these women and join in on their conversations it might stike a different cord on how you think. But you might have to make more than 1 complaint to get the message across, so they take it seriously. Just keep complaining, I'm sure they will move you.
