Should I sue a liar dentist?


I had a '' free consultation'' with a dentist for invisilign. She said I needed an X-ray and I didn't want to pay for it. She said most of the Insurance companies were paying and they were going to ask to my insurance company to pay for it. She gave me an estimate for $1,300 more than she gave to my friend even we had the same problem. They asked me to pay the $125 for X-ray and said they couldn't get the confirmation since it was after 5 pm and they were going to send me a check once they get the payment from the Insurance company. I received a letter from my insurance company indicatiing that I owed $250(!!!) to the dentist and insurance was not paying for it.The doctor's office claimed the sevices they never delivered!!!

Beside being tricky and liar, these people shared my private information with a friend of mine too!!!!

I doubt it, mainly because you have to prove you suffered some type of loss. True, you are going to have to pay $250, but hiring an attorney will cost much more than that. Also, a case could be made for your own negligence in buying that "it's after 5 p.m." story and allowing them to take the x-ray. You could have said you'd be back the next day or whenever, especially since you were just having an estimate and it wasn't an emergency.

Your best bet would probably be to file a complaint with whatever regulatory agency handles dentists in your county / state.

Definately, what are you waiting for? They lie to you, take your money for nothing, overcharge you and to top it all share your confidential information to someone without your permission. Nothing seems right or fair to me here.....

Absolutely! Any doctor who gives out patient information and screws up services rendered cries a lawsuit.

The free consultation probably didn't include the fee for the xray, only the exam.

What did the EOB (Explanation of Benefits) say was paid? And what wasn't covered? I wish I could see a copy of it, so I could tell you what they billed for, and for how much. This could be insurance fraud, that's for sure. (Feel free to email me)

Get a copy of your statement showing your balance. It should say what was done and how much the fee was. Compare this to what your insurance paid. If there's a discrepancy, call your insurance company and let them know.

As far as violating your privacy, that's what HIPAA is for... sounds like your next consulation is with an attorney..

If you're going to do this, I wouldn't go about hiring a lawyer, it'll cost you thousands. Take it to arbitration. You'll get a decision in less than an hour.

Well you can certainly try. Next time, I am going to need you to contact your own insurance and get the info before you go to the dentist. Moreover, stay away from this dentist. Sounds like she is running a scam.

Unfortunately, it would be your word against theirs. UNLESS you have what they told you in writing and signed between you and the dentist. I have learned this the hard way--similar to the way you have.

You could waste your time trying to find a lawyer to take this go-nowhere case or you could actually go into the office and try to find out where the misunderstanding is. They probably have no clue what is going on with YOUR insurance company and may have a solution.

It's worth a try. Once you start bringing lawyers into this, the office won't even be able to talk to you.
