Is it illegal for your attorney to share your information? |
recently my attorney released details of my case to an individual who walked in to his office and ask him questions about it. after learning about this i was disturbed because i never signed a waiver or any kind of consent to let my attorney share my case. and im wondering if what my attorney did was legal. the person who came in to his office is the individual im im filling a claim against. Does the other person have an attorney? If s/he does, then your attorney shouldn't be talking to the other person. If this is true it should be a big red flag for you because it would be unethical period. is your attorney part of a partnership? Attorney-client privilege is a legal concept that protects communications between a client and his or her attorney and keeps those communications confidential. This privilege encourages open and honest communication between clients and attorneys. However, in the United States, not all state courts treat attorney communications as privileged. For instance, Washington state law, and the federal courts when applying federal law, only protect client communications鈥攁n attorney's communication will only be protected as privileged to the extent it contains or reveals the client's communications. In contrast, California state law protects the attorney's confidential communications regardless of whether they contain, refer to or reveal the client's communications. In addition, the United States Supreme Court has ruled that the privilege generally does not terminate upon the client's death. See Swidler & Berlin v. United States.[1] Depends on the laws of your state, the info released, the agreement you had with the attorney. Are you sure that the individual is telling you the entire story? Did the attorney release you name or some identifying data? Why was the individual asking? Was it a relative, a partner in the firm, another lawyer or worker in the law firm that will be doing work on the case? ask what was said no matter what the law in my state is no waive signed no information of any kind not ever your fave color. find out the law and see what your lawyer said |
