Credit Card Dispute on eBay/Paypal. What should I do???


I have a problem here. Anyone who knows how to fix this, please let me know.
I sold an item to a buyer on eBay. Buyer paid (but did not opt for insurance). I packed nicely and shipped as usual. Unfortunately, there was something bad happened during the delivery. The package arrived to buyer damaged and out of shape. Was unable to file claim with post office (since no insurance was bought). I offered to share a portion of loss with the buyer but the buyer wanted more. I refused and now the buyer went to file chargeback with credit card. Is that reasonable? Will Paypal send me the chargeback?Can I fight back? What can I do to protect myself? At the beginning I set the insurance as optional. However, the buyer did not take the option and now the buyer do not want to take the loss. What shall I do?

The buyer filed chargeback/dispute with his credit card company (not Paypal). Will Paypal frozen my money due to this when they receive the chargeback notice from the credit card company? Can I fight back successfully? The buyer returned the damaged item to me without giving me notice. The buyer bought insurance on the returned package (damaged goods). Did this violate any postal regulations?

You can let paypal decide, by escalating your dispute to a "claim". Explain to the paypal rep that you packaged it properly, and that you did offer insurance but the buyer declined. Paypal is usually reasonable, and you'll probably end up sharing the loss. Insurance is also there to cover the seller, not only the buyer, unless you clearly stated in the item's description, something like, "Seller is not responsible for damage in transit if insurance is not purchased."

I bought a DVD once, where the description stated that it was in good condition, but when I put it in my DVD player, it skipped and wouldn't play properly. I filed a claim with paypal, and I got a full refund, but had to pay to ship the DVD back to the seller. I know you don't want the damaged item back, especially if it was in good condition when you mailed it. Things like this happen when you sell on ebay, but in all my years using ebay (as a buyer and seller) I have only had one person who I had to refund, and only one person who had to give me a refund.

Good luck with future transactions, and always remember to make your shipping, insurance, and return policies clear.

First, you as the seller are responsilbe for insuring an item, not the buyer. You are finding that out now, aren't you?

Second, you will lose this claim, because almost anytime a buyer makes a claim with his credit card company, the seller loses.

Next time, buy insurance or pack the item better. Since the seller actually ships the item (or doesn't ship it at all, or doesn't purchase insurance,) how can the buyer protect himself against loss? He can't. That's why the seller is responsible for insuring the item, and why you will have to pay up.

You could try to fight the chargeback but I think you would lose. The buyer didn't get what they were paying for. That means you are out of luck.

In the future, add the insurance to the shipping cost.

You NEED to find out if you are seller protected. For the seller protection the item had to be sold on eBay. The item had to be shipped in 7 days. You must also be able to supply a tracking number. If you are seller protected you lose no money.
