My employer found it necessary to share discipline problems he has with me with a former employee...legal?


I have been extremely ill for the past four days, in and our of doctors offices and the ER. While I was gone, they brought in a previous employee to do some odds and ends. While she was here, they apparently told her some "problems" they were having with me. Is this legal, can they do that or does it not violate a confidentiality agreement of some sort?

No, definitely not. Your employer has no right legally or otherwise to discuss employee-employer issues with another employee...especially one brought in on a temporary basis. Any issues your employer has with you should be kept confidential and not be shared with anyone else except possibly your direct superiors or his/her superiors in the company.

Again, unethical but no violation of Federal Law.

It all depends on the state you are in. It could be a privacy issue for which you have a claim.
