Attorney didn't represent & Sent Bill - Traffic Ticket?


One of the Attorney whom I contacted from Yellow pages sent me a bill of $400 for a case which he didn鈥檛 follow through (Speeding Ticket) nor represent me in Court .

The agreement was I pay a fixed sum of $400 once he clears me of my ticket & represent me in the Court. 40days prior to the court date, He sent me 2 letters & a copy of the Violation report. I asked him to find a settlement & get the ticket dropped.

I didn鈥檛 here from him after that I called his office several times but never got a response & finally I sent him a email One week before the case telling him not pursue this case any more.

This was my first Ticket in 8year driving history. I spoke to the Prosecutor & got the Speeding ticket dropped by doing safe driving course & community service .

I don鈥檛 want to pay this lawyer, it was a verbal agreement only & How can he Bill me at the rate of $175 per hour. Can I ignore his Bill or Should I be paying this Lawyer - Please Advise.

Whatever you do, do not ignore the bill, as it will just get sent to a collections agency and show up on your credit report. You need to send a letter via certified mail to the attorney's office, stating your position and that you feel he did not fulfull his obligations under the contract and as such, you feel he is not entitled to payment. Then he can present his side as to why he feels he is entitled to payment (perhaps in some way he believes that he did fulfill his obligation, even though he did not represent you in court, and did not clear your ticket.)

Also, since you told him not to pursue the case anymore (essentially telling him to not represent you in court), you actually never gave him the opportunity to fulfill his obligations (representing you in court, and getting the ticket cleared.) As such, it sounds as though you would be liable for the attorney's billable time for working on your case (and there was probably some fine print stating as such.)

An attorney can charge at any rate s/he wishes too. Plus, you agreed to it. Secondly, according to YOUR statement and the email you sent to the attorney, YOU told him NOT to pursue this case any more.

Therefore, YOU owe him this money. If you do not pay, more than likely, you will be sued and be paying a lot more!!!

Anymore rather it was a verbal or a signed contract your liable so you better just pay the lawyer or in breech of contract, and he could sue you..
