Statue of limitation lawsuit against postal service for slip and fall suit? |
I had an accident at the post office in january 2003 and it was their fault with evidence and all. what is the statue of limitation on slip and fall suit againt them (being under federal juridisiction) because when I first got injured, all those so-called tv lawyers said I didn't have a chance of making a lawsuit even though this is still a life changing accident. look another lawyer the other day said that I could have a chance out of curiousity. damages, well my right arm is disabled, I am cripple if thats what u want to know, with the help of workers comp and all this all bullshit. so when you think about it no I am not tryig to sue I just want to know my rights even though its amazing how people think I am trying to sue for financial purposes even though literally I am how you say "****** up" Sorry but you long since blew the statute of limitations. The max I know of in any state is 3 years. Plus since the US Postal Service is a federal agency they have sovereign immunity which has been partially abrogated by the Federal Tort Claims Act. This means that in order to sue the Federal Government there are even stricter requirements. One is that you notify a specific federal Representative, which varies by the agency within six months or so from the time the accident happens. If you don't do that then your suit will be booted out of court. Too long has passed. If someone wants to take your case on a contingency fee maybe. But don't pay anyone any money you'll be wasting it. And the TV lawyers usually do know what they are talking about! It would depend on what state the injury occurred in, however 2 - 3 years is pretty common. "Those so-called TV lawyers" would know what the SOL is in your situation. Life changing how? If its been 5 years I think a 'slip and fall' is kinda off limits. And also, if its been 5 years why are you trying to sue now? Please don't sue for profit. It hurts all of us. Ambulance chasers should not be tolerated. |
