Texas - Is it legal to write up an employee up for EXCUSED absences?


I was required to sign a notice of unprofessional behavior, b/c I have had 10.5 hours of absences over the past 5 months - all EXCUSED by hospitals and doctor's offices.

I had a DNC and was out for 3 day. I also got the flu, and was out for 3 1/2 days. B/c the flu was misdiagnosed, I ended up with bronchitis. I was unable to do my job - Customer Service Rep - for 4 days due to loss of voice and coughing.

I have an HR degree from Texas A&M, and when I got my degree, this was not legal. Besides it having nothing to do with "professional or unprofessional behavior," I have been medically excused for my absences.

My job did NOT pay me for the days I was out; and though I did inadvertently-w/o intent- inconvenience my coworkers, it resulted in times where my customers received less than quality service. However, there was no way to avoid this, and it was w/o intent.

So - did my company have a legal right to write me up?

Oops - I meant 1o.5 days of absences

A write up is not a legal document. It's offen used to provide documentation when a termination may be necessary. Also, you live in an at-will employment state.

Whether or not the absences were excused or not doesn't impact the fact that you may be of diminishing value to your employer.

I am sure they covered this in the HR program at A&M.

You're lucky you weren't fired.

It's not highschool where you have excused absences and you get to make up your grade. your employer obviously felt that you abused your excused abscense right and therefore wrote you up. If you are a great employee one write up shouldn't scare you.

Excused absences and doctors notes are not the issue -- it's the issue that you missed a significant amount of work and your employer is putting you on notice.

People are under the impression a note makes it all better when you miss a day -- this isn't high school.

LOL. There are no legal 'excused absences' in the real world or work. Unless it is specified in your work contract, if you even have one, that you are entitled to certain amount of sick leave and vaca and you followed the steps of your contract to the letter in using this time then they can absolutly write you up for missing work. You need to talk to your hr dept not look for legal excuses on here. Its all company policyn specific to your company.
