I have a company in the US that will be providing a service in India. Do I need to incorporate in India? |
We will be incorporated in the US and provide a professional service to people in India. We will not have a presence in India (meaning no office) but we will occasionally be in India to deliver our service. Do we need to set up a corporate form in India to do business there? What are the local Indian filing requirements? The specific service we will be providing is admissions consulting services. We will not set up an office there. However, we will be providing a good amount of the services in India. Specifically, we will be holding 1-2 day workshops a few times a year in Indai and deliver the services that way. We will take payment in advance via the web. We will be set up in the US as an LLC. Given all of this, do we need to incorporate in India? if you are collecting money on web site why cant you provide consultancy online? For providing consultancy in India you atleast need to have a representative office here. Since it will only be a representative office you dont have to register as an incorpoarted entity but you have to comply regulations of FEMA as applicable on representative offices. Since you will recieve money online i.e. outside India you dont have a tax liab. here...It will be interestinjg to know what kind of services you render here though... What kind of business is it? If it's like a medical transcription service, you don't need to be incorporated in India..if you don't setup an office there, you don't need to register. |
