How do i get a death certificate filed, after i have been to the funeral service commission?

my friend died on 1-23-05, and still the funeral home has not filed a death certificate. i went to the texas funeral service commission 10-19-05. the funeral home was found in violation of texas laws. the funeral home appealed the decision and now i am waiting on a date for the office of administrative hearing to hear the funeral homes case. in the appeals process there still has not been a death certificate filed for my deceased friend.

I don't know Texas laws, but in my state, Funeral Directors have seven days to fill out the death certificate, and get it to the Doctor or Coroner (or whoever the appropriate person is) to sign it. The Funeral Director then files it with the state department of vital records. Assuming that there are no problems with it, it is available for family members, etc. to get certified copies of within about ten working days.
It certainly seems that this Funeral Home is taking way too long to get the Death Certificate filed, and that is probably the violation they are currently appealing.
I suggest you call the agency that found the Funeral Home in violation in the first place, and ask about the status of the case. Find out the name of the attorney handling the situation, and speak to that person. See if s/he can tell you when the Death Certificate will be filed, and when you may be able to get a certified copy.
This must be very frustrating. Certified copies of Death Certificates are needed to transfer property, settle insurance, and settle estates. Good luck with this.

Texes. Figures.

Funeral homes do not issue death cerificates in my state. A physician or Medical Examiner, who is an MD, does. However in Texas they do.

Go to the state office of vital records. I believe one must be filed within a certain time frame. Maybe they even have it.
