How do I build a good case against VA for a service connected back injury?


My back is the reason that I was released from the Marines in 1997, I have been fighting VA ever since. I had to pay for an MRI myself because they said nothing was wrong with my back, and now the lumbar part of my spine is bulging to the point that it cost me a job at the Post-Office even after I passed their test, urinalysis, and a physical. The reasonable accomadation board at the Post Office said that I was unsuitable to work there, I have very limited income (Disability Compensation 20% for a busted back). Where does a veteran turn to get help for this case?

Take all your medical records and visit the local DAV- Disabled American Veterans. This organizations has helped millions get their due, all it takes is Little of your time.

Try a lawyer.Also go the VA and put in for an increase in your DA %.If you hurt your back while in service you should have a good case and if you have lost employment because of your in service injury you should be able to get an increase in benefits.It all depends on if you hurt your back while in service or not.

You should have medical records, especially if you were given a medical discharge. Are they saying it was a pre-existing injury?

You can appeal their decision!

You say you were released, but did you receive a medical discharge? Did you have a medical board? Did you receive a disability percentage from the Marines? If you answered yes to all of the above, did you then file with VA and enclose all of the documents from the Marines or Navy? Have you had a VA physical? Have you been rated at all by the VA?

You say you have 20% disability compensation, but you don't say who you got it from or how. More details would be helpful.

As said by the rest here, not enough info to go on, but the most the VA will give anyone is 60% for any back related problem and that is if it can be proved to be service connected.
