Landlord says mistake on house given even though lease signed.?


Question Details: We're military moving into old military housing that is now privatized. Hubby flew out to sign the lease today and has flown back tonight.

We're now being told there was an error in the house they assigned us (message left on voicemail after hours so we couldn't call back and knew he'd be on an airplane unable to answer).

Trying to see what our rights are before calling in the morning. Can they just say it's an error and tell us we've lost the house? I'm assuming they are in breach but what can we do with that? Dealing with this with a 4 yr old and 6 1/2 months pregnant, can't take much more stress. There office has been a zoo from day one.

One more note, the lease is post dated to the 5th of June because our household goods won't be here for a couple weeks, this was to avoid extra prorated rent.

Sorry, the property is in California. It's not really military housing since it's been privatized it's now civilian run. I do not see any delay of occupancy listed in the lease.

The phone message is very vague. We need the larger home (they had smaller ones to offer, but we did not want). Even if another is offered if it's not the same (size etc) I'd still imagine it's a breech of contract right?

There is a liason we plan to call in the morning as well. Just wanted to know our rights before talking to them in the morning. Want to be armed with our rights.

Really depends on the provisions in the lease. Most have a "delay of occupancy" clause that can release the either party. Unfourtunately, this happens alot on post housing. I had my belongings dropped on the front lawn at Fort Carson by the movers because we had trouble getting keys, and I finally had to just "stake my claim" at the house I signed for!! Anyway, yes they legally can transfer your unit or delay your move in, and they really have no heart (or common sense), so they kinda gotcha where it hurts. Don't stress yourself out tonight I am sure they will have a unit for you it just wont be the same one.

Assuming this would be a rental by a private owner OUTSIDE of the military base? Did they care to ealaborate on what has happened? Will you be assigned another house? You did not say where you lived that would be helpful in posting our answers. Have you talked to Base Housing office about the issue?
