Is there any action I can take against salliemae.com?

I recently applied for a loan from salliemae.com over the phone. I am a student at Appalachian State, but when applying for the loan I made it very clear that not only am I not attending summer sessions, but I will not even be in Boone for the summer, which is where the college is located. I told the woman processing my loan very expressly that it was purely to help me pay for a few months of rent. She approved me and told me that there was no problems, and that the school would be sending me the check shortly. After over a week of trying to get hold of the school's financial aid office, I finally reached my advisor, who told me that there was nothing that they could do, because according to federal law, a student cannot get a student loan during the summer months unless they are enrolled in school those months. She went on to tell me that anyone who is giving me a loan should have been aware of this. They have now left me high and dry with no way to pay my rent. Can I do anything?

Nope. I would report the loan officer though. She should not of let you maintain the impression that the money would be available for non-education expenses.

You could always make the school send the money back to repay the loan or leave it with the school until you return to classes.

She probably thought you meant for the loan to start next fall when you return to school.

You should know you don't qualify for a student loan at times when you're not enrolled in classes.

We have no way of knowing if you stated what you claim you said to the woman on the phone. There is nothing in writing, and if you don't have it in writing, you have no recourse. If you tried to sue, it would be a he-said, she-said case and those go nowhere. You cannot prove what you said; you cannot prove what she said.
