Does the landlord have to give notice PRIOR to entering your apartment?


. We moved in 6weeks ago and we feel like were being harassed .The maintenance people have been in here twice while we were not home..once to change the air filter and once for pest control, ("which will be done monthly unless leaving a note on the door THAT DAY!"/ WHAT DAY?)The people in the office have left messages on my cell phone and called my job 3 times just for my email address. our rent is prepaid for the first 4 months and we just want to be left alone or at least notified EVERYTIME they are in our apt. Its ridiculous!! What are the laws regarding this and how can i get it in writing so that i can submit it to them. AM I WRONG!?

Does my landlord have a right to enter the rented space?

Yes, at reasonable times. But the landlord must have a reasonable purpose, such as to inspect the rental unit or show it to a possible buyer, and must give you a 24 hour verbal or written notice before entering, unless there is an emergency or if you have agreed to let the landlord in without notice, or if you have made a written request for repair within 7 days before the entry. The landlord may give the notice to you or, if it says so in your written rental agreement, the landlord can mail the notice and securely fasten a copy of the notice to your door. (The date on the postmark of the mailed notice is the date that you are officially 'served.')

You have the right to deny entry to the landlord for good reasons; you must tell the landlord the reasons before the time the landlord intends to enter. Tenants can be evicted for unreasonably denying entry.

The landlord must also give you notice before entering the yard of a single-family residence, or any other space rented to one tenant. But the landlord may enter the yard to do yard maintenance without giving you advance notice if the written rental agreement requires the landlord to do the work and if the work is done at reasonable times. (The landlord is also allowed to come on the property to give you a notice or post one on the door.) (ORS 90.322)

If you have requested repairs in writing, the landlord or the landlord's repair person can enter your home without notice or consent, if the entry is to make the repair and is at a reasonable time. The landlord only has this right for 7 days after the written repair request. The tenant can tell the landlord in the written notice what times the entry is allowed.

The landlord and tenant may agree in writing that if the property is for sale, the landlord may enter at reasonable times, without giving notice, to show the premises to prospective buyers. Both the landlord and tenant must sign the agreement

I have also read many different articles that it does depend on what state you live in and if it is in the lease.

Even though your management company seems rather out of touch with proper notification of their so-called monthly maintenance efforts, even with cellphone and email backups, you should send a written notice to the management company outlining your rights to receive a 24-hour prenotice of any entrance into your apartment. Failing that strategy, you can seek a formal TRO against the maintenance people, the management company which will likely put you in poor favor with them. But you'll have at least gained some privacy along the way.

For any emergency such as a leak coming from your apartment, suspected criminal activity, fire, flooding, then yes. For most other reasons he/she should give some notice. I have a contract with an exterminator and tell my tennants when they will be coming and that's that. I don't barge in...that's rude. Any general maintenance is done with your privacy in mind. However, if you leave the bathtub on and it floods my apartment then good luck seeing much of your security deposit or a renewal of your lease.

You have to read the lease that you signed, everything is in there. Every apartment complex is different. Some say they don't have to tell you if its for fixing crew, some say you have to be present when they are working in the apartment, so its all in the lease that you signed.

Just to be sure, re-read your agreement. Talk to the people themselves, and ask them where and when and where notices will be left. Try to be nice first. If they continue to be uncooperative, then i THINK you are in your legal rights to have notification of them coming. When i stayed in dorms in college, we did not have notification of them coming to change filters. I would check w/state law.

From what I know, if it's not an emergency they leave a note on your door(for cleaning, repairing, or whatever) But if there's an emergency, they don't have to. Some may go in if they suspect something bad, but they usually call or knock.

For scheduled maintenance 24 hours notice is required before the enter. As for pest control that may be a little different. The landlord probably doesn't always know when pest control is going to show up. Be glad you have that service.

i am not an attorney but if you live in michigan I belirve the answer is NO. do you have a local legal aid group if tou do contact them. i live in michigan. owners can not come in without first askinf. good luvk

Reasonable notice is required for non-emergency situations [California law]. Twenty four hours is normally considered reasonable.

What is wrong with allowing the pest guys in your apartment? Isn't it better than bugs?

Check your lease. Ours says that the landlord must notify us a minimum of 24 hours in advance.

Read your lease agreement....
