How do you seek legal action when the office loses your rent?


In February I paid $1,520 to my rental office. $1,020 of the money was lost in their office and I didn't realize this until I began receiving notices stating that I still had a balance due of over $1,000. I showed the office my receipts but when I traced the money orders they had not been cashed. I spent another $58 to place stop payments on these money orders and in March I paid double the rent to make up for the money lost. My office claims that they will reimburse me if they can prove they were negligent. However, to this day they refuse to acknowledge that they lost my money orders. In addition, I lost days off from work having to go to court to fight a threatened eviction and prove that I paid my rent.

If you have already paid the rent and still have the money order receipts, If they havent been cashed, the company the money orders are through should refund your money, especially if you stopped payment on them. They ususally do this within 30 days. How do I know? I used to use money orders to pay my rent and had this happen to me once. I stopped payment and got my money back because they hadnt been cashed yet.
Unfortunately, you have the burden of proof to show that they actually received the money. Just because you have receipts doesnt mean that they were made out for the rent and given to them. And they cashed the one that they had for $500.oo. I think that they would have cashed them all together if they were there.
Even though you proved to a judge that you had receipts, the judge actually gave you the benefit of the doubt. Why? Because you could trace the money orders to see if they were cashed.
Get your money back from the company that issued the money orders. They cant keep it. The $58.00 I wouldnt lose sleep over, you would have to do it even if it involved someone else.

if they gave you a receipt for the full amount then they should absorb the cost of the stop payment fees and something for your time of getting them replaced.

If they did not give you a payment receipt and you just have your money order receipts then you have to bear the cost. Always get a receipt of acceptance.. its not a trust thing.. its just business.

Do you have proof they got the money orders? Besides your word for it I mean. You say you gave it to them, they say you didn't.

If not, just forget about it. You will drive yourself nuts over
$ 58.00, and it's not worth it.

The receipts from the office ought to be adequate to prove they received the money. Did they give you a receipt for the money you paid, or do you just have the copy of the money order? Money orders can be replaced after stop payment.
