Rent after eviction notice. I am being evicted but my landlord's office returned rent last two months.? |
as there is probably going to be time before i have to move out either through settlement or through the eviction proccess will they not take rent because it makes legit the tenancy i have basically they are trying to get us out of a rent controlled apartment so they can double the rent - this, of course, is nyc!! And you have not been to see a landlord tenant attorney because ..... ???? If you are on amonth to month lease, yes they can do that and it will take 28 days or less. If you are on a lease they cant just kick it out, it must go thru the court system. Seems like you would of got some kind of paperwork the first month they kicked the rent back to you, if they did, it will be any day now. Better to go peacefully than have the sherrif come. boy if they're giving you back your rent (and not accepting it) they must really want you OUT - what'd you do to tick em off so bad? you can bet if their returning your rent checks - they'll go thru court to get you out as fast as possible - seen it happen in as little as 14 days in some states (getting the boot) Don't spend the money, because when they take you to court , the judgement will be in their favor and you will owe the back rents too, as well as have to move.. |
