Can I sue my landlord for an invalid eviction notice?


I just moved to a new apartment. I signed the lease, paid the full month's rent to move in, and got my keys. 3 days later, I get an eviction notice stuck under my door asking me to vacate the premises within x amount of days because rent was not paid and that I because I had not paid I violated lease terms. Well, that was bogus and impossible since i had a copy of the check and they wouldn't have given me keys or allowed me to move in without the payment. I went to the office, turns out they double entered my rent balance causing me to be charged twice. Being that the eviction notice was totally unreasonable and invalid (they wanted to tear it up in front of me but i held on to it), can I sue them for this?

You have to have suffered a loss in order to sue. What would you sue over?

Sue for what? In order to sue, you will have to prove damages. And you haven't been damaged - except to have your feelings hurt.

However, you did learn a valuable lesson - they will not allow the rent to be late.

Why does everyone want to sue for trivial things like this?

No, you were not damaged in any way. However, you should run a credit check in a few months to be sure it wasn't put on your record.

No you can't sue them. What damages did you incur? Technically, its not an eviction notice to begin with.

Just tear up and move on with your life.
