Can a landlord force you to renew your lease in Ohio? |
We signed a lease when we moved into this apartment three years ago. It was a one year lease. The office never contacted us to renew the lease. Now we are looking for a place but not for about 4-5 months from now. But our landlord sent us a letter saying it was time to renew our lease. I dont want to lock myself into another year lease and i didnt think that he could make me in the state of ohio, I figured after the one year lease was up we would be on a month to month deal. We honestly think that he is just trying to raise the rent on us. Please help Your landlord can't force you to sign a lease. Once a lease has expired, you automatically become a month to month tenant. Either party can sever the relationship with 30 days notice. You should just tell the landlord your plans. Tell him/her that you don't want to sign a lease at this point and you may be moving. He will probably be OK with that, but you may have to pay a little higher rent. So be it. You can't expect your rent to stay the same forever. I'm not familiar with Ohio law, but I've never heard of a jurisdiction where you could force a landlord to be on a month to month basis with you. If the landlord wants a lease, and you don't want to sign one, he can give yo appropriate notice and terminate the tenancy. If you know when you plan to move, you can negotiate the lease to be that length of time. The landlord is entitled to raise rent, most landlords do. I am not sure about the month to month lease, I think in some cases if you don't not inform them within 30 days of the termination of your lease that it can auto-renew for another year. You may want to contact your leasing office to find out how their leases are set up. Also from what I understand, if you are on a month to month lease, the landlord can raise your rent at anytime with a 30 days notice. in Ohio, Russia they can make you sign - you ARE on a month to month lease - the bad thing about that is - he can increase the rent whenever he wants for any amount and do it more than once and there's nothing you can do about it -he doesn;t need to get you to sign a new lease to raise your rent - didn't he raise it every yr after the anniversary of the lease signing? he's an idiot if he didn't |
