Question re: renewing an apartment lease?


I live in northeast Ohio and in managed apartment community. I have a 12 month lease that is expiring on April 30th. The management office required that I tell them by the end of February what my choice is for renewal. If I renew for another 12 months my rent per month will not change. There was also an option to renew for 9 months or to go month-to-month at higher rent amounts. I decided that I was going to go month to month in hopes of buying my own home. I was informed that the rent prices have gone up this year as well by $15. I asked management today about possibly renewing for another year instead of going month to month and they said that if I did I would have to pay the higher rent. Since it is still more than 30 days until my original lease expires and they did offer me in the renewal notice the same rent amount to resign for one year, are they really able to force me to pay the increased rent?

Yes. They needed an answer by the end of February. This is when they go through their books for tax season and decide what the increase is going to be. You decided month to month. They have every right to charge you the higher amount. At least they gave you the option. My lease ends in May, and my landlord can increase my rent. A lease is considered rent control, this protects the residents. If you cancel on the lease the land lord can make you pay for the remainder of the lease. This is what protects the owner. Besides, its only 15 bucks. Be thankful its not more. Take the lease as is now, or you could face more increases. Unless you can get yourself a new home soon.

Yes they offered one deal, you rejected it, thinking about going for the month to month, now you changed your mind they do not have to offer the original deal since you rejected it

should they make the original deal maybe but not required to, note while they are still tied into the original terms, as soon as that lease ends and you go month to month they can with month notice raise rent or move to terminate the lease

Tell em to stick it, your moving unless you can sign for another year at the same amount you where paying before. Apartment manager's don't like empty units, because then they have to do a bunch of paperwork and take a chance on a new tennant. You have the upper hand
