A question for landlords is this legal? PLease help!!?


We live in a loft apartment above a business, we were paying 450 a month in rent last month when I went to pay my rent the landlord tells me that she no longer takes the rent because she sold the building to this lawyer, so I went to his office and the secretary told me to call him.... I left a message that was never returned. Then his "partner" shows up with a demand for payment saying we owe 700 dollars by today or the are kicking us out!! We have 3 small children when I tried to tell him that we could not possibly come up with that he said we wouild have to move because his rule is rent on the first or eviction (we had it set up with the old landlord to pay half every two weeks) we cannot afford the deposit on a new place and he says he is not returning ours what are we supposed to do now?

OK, I am going to assume their is nothing in wiring? if so then by state statute you have a month to month

I would send a letter to lawyer stating the rent is currently 450 a month, you have proof that this is how the old landlord accepted payment, keep it simple and say little, just a simple straight forward letter stating rent is x, they are bound by the old terms of the lease until with proper notice they offer new terms, which it sounds like they have not done yet

But under month to month rental, all they need to do the new landlords is to send a month notice of change in terms, then you have a month to accept or a month to leave

Note only a court order, and a sheriff officer can kick you out, but if they do file a complaint be sure to show, offer proof, of the old payments,

also the new owners are responsible for your security deposit even if they did not receive it at closing

but talk to a lawyer in your area for the best advice

Lawyers ... Point out you weren't given proper notice that the building had been sold and when you did find out you in fact did try to make a payment but were put off. Offer the $450, if they accept the payment they can't come after you for late payment penalties. If you have a lease in place you will be able to keep your rent where it is but you must abide by the written terms of the lease (paying the whole rent on the first of every month instead of half every two weeks). Don't let the lawyer bully you! Even if he initiates eviction proceedings it doesn't mean you have to move. Instead you get a chance to explain your side of the story to a judge and if he decides there was no breach of contract in your lease you can stay. In the mean time pay the entire ($450) rent today!

threaten to file suit. as an attorney he will know the laws and he is breaking all the rental laws on the book.

No they cant do that depending on the state you are in. wisconsin they have to give you a written notice first. I am a landlord and there is no basis on a verbal demand for payment
