Do I have to buy out my lease?


My fiance and I had a lease on our apartment that ended at the end of the year. We were not sure if we wanted to re-sign for another year so we chose month to month. Apparently one of the ladies in the office drew up a contract for a year and entered it into the computer; however, we never signed the new lease agreement. Are we committed to buying out the lease or can we just give our 30-day notice along with a final months rent?

If you didn't sign it then you reverted to month to month and only have to follow those rules. If you didn't sign the new one then it isn't a contract, it is an empty form that might be ready to become one but it isn't a contract. Much like that kids cartoon about a "bill" before it becomes a "law" we all saw as kids on saturday when I was growing up...

If they try and strong arm you, make them show you the signed lease and that will be the end of it.

If you did not sign the new lease, and your fiance did not sign the new lease, then you are probably on a month to month lease. You must sign a lease for it to be legal and enforceable.
