Health and Safety question?


I rent a shop unit in an inshops center which is falling apart, in my shop plug sockets are falling off the wall and spark when you pull a plug out, other people have the same problems, one unit has no celing and it has been known for burglars to get in through the roof when the centre is closed, their are holes in the floor all over the place, the manager has put yellow tape around them and says that is sufficiant but i saw an old lady trip up 2 weeks ago and many more almost go flying. the fire door is falling off it's hinges, tiles falling off the walls and this morning a burning plastic smell coming from the roof somewhere above our shop and the cafe.

All the traders in their have reported all these things to tha manager who says their is nohing she can do.I have reported to the main office and they say it's not down to them.

Everyone who has a shop in their is on a contract and have paid huge deposits which they will not back if they leave.

Can i report this to anyone? what should i do?

check the terms of your contract, it usually states who is responsible for looking after what, your landlord is usually responsible repairs and general maintainence, but you would be usually responsible for day to day stuff such as light bulbs and general decor in your unit. However it clearly sounds like a deathtrap so I would ring your local authority and ask for a health and safety inspector to come out and inspect, you can do this annonomously (concerned granddaughter of the lady who fell maybe?) and hopefully this will help you get these matters resolved.Do you have any access to the risk assesments and fire risk assessment documents that are required by law, if you study them you probably find they are saying that they are doing loads of stuff to comply with the legislation but clearly are not!If the unit closes because of Health and safety reasons you should get your deposits back as it is out of your control. good luck.

Get legal advice. It depends on what's in your contract as to who has responsibility for repairs.
The tenants should act together on this as you're all affected.

Bring it to the attention of the Health and Safety Executive

bloody hell! thats awful someone could sue you for health and safety reasons that is not good! might be a good idea to all club together and see the manager all together and tell her that she has to sort this out or you are going to all lose a lot of customers, this is unaceptable! i believe she is breaking the law doing this she must always make sure that your shops are a safe environment for everyone dumb cow! if you are a member of a union you can get in contact with them, if not then go back to the main office and tell them that your manager is not sorting it out

are you in the UK?

the owners of the centre have a duty of care and they are in major breach of that.
you can either report it to your local authority or even better to the HSE.

they will carry out an inspection and (if really bad) give prohibition notice or will issue improvement orders which have to be carried out within a short time.(and is followed up
