Re newing my lease problem. My landlord over charged me,.?


Ok..I just re newed my lease for my apapermtn too a 12 month lease in which the contract stated i get 200$ off for agreening to the 12 months...I have my rent pay through my banking account which is taken out on the 3rd of every month...And by agreeing to the 12 month lease i get the 200 off my rent..I am paying 715....and it was suppose to go down too 515....Well they didnt take the 200 off my rent and it went through my bank and I only had 730.....and I had it written in my check book that I would still have 230 dollars left in my bank..Well obviously i didnt..they left me with 31 dollars i piad 5 other bills I started getting over drawn fees that now up too 5 plus negative in my bank...I spoke too the clerks at the front office and they told me it isnt their fault that they arent gonna cry over spilt milk...So i tried connacting my owner and she will not answer...I have no money left over...the bank took my work check and left me with nothing...What do I do?

Ok i spoke with my bank. I been with them for 3 years...they are completely on my side, They know me by name and face....they were very understanding...so they halfed my fees..butt still i am over drawn.....not happy tho that I lost my entire 570 dollar check from this weeks pay from work..They suggested going to city hall and asking questions...I feel like they should re pay me my personal fees and my work check do you think it would be possible to sue? I am not a person that is quick to Sue but i feel very much like they dont care about my well being..I cant even get to work no due to me not having in cash...I commute to work with an hour drive.

Your landlord has to honor what your lease says. So I would ask for a copy of your lease and read it carefully. Then put into writing what you are asking to be refunded, including any overdraft fees give them a dead line to respond to your letter and tell them you will be seeking legal council if they do not respond to you. That should get there attention enough and they probably wont take it that far. also if there are any errors, words spelled wrong, your name spelled wrong, or descrepincies... that will void a lease. If there are any also let your management company know that as well.

i would also cc the letter to the corp office.

Its not the banks fault. If you agreed to let your landlord take out payments and they overdrew your account that was your landlords fault. Talk with them about it and tell them they need to pay for any overdraft fees that they caused you to make as well.

Are you sure its $200.00 A MONTH off the rent or $200.00 off 1 months rent for resigning? You had better re-read the lease. I have a feeling that it is the second option. Otherwise your landlord is a fool and is desperate to keep you. No landlord in there right mind would drop the rent $200.00 a month if he is getting $715.00 already. I think the $200.00 was a one time thing.

Josh is right. Another thing you need to do is stop that automatic withdrawal that pays your rent and pay your rent by check.
