Major problem with apartment manager?


Ok so here is the deal. My lease was up yesterday to my apartment. I moved out on the 12th because I couldnt stand living there anymore but paid rent until the 31st.

I went there today to talk about the security deposit and get my last mail since my lease ended yesterday.

The lady in the office said that someone already moved in "Today". So apparently they cleaned my apartment and cleaned the carpets while I was still paying the rent and it was my place.

Is this a violation to go into someones apartment without authority to do so and without permission?

smartypants has no clue what she is talking about, the only way it would have been an abandonment of property is if you did not pay your rent for this month. But since you paid your rent that made that apt yours until yesterday. That means that had you not found a place until last week you could have stayed in that apt until the new apt came available or yesterday which ever came sooner. They had no right to move someone into that apt until today and if you can prove that they moved someone new into the apt sooner than today you can take them to court and get your deposit and some of Jan rent back. They would have to prorate your rent from the 1st until the new tenant moved in and you would get any remainder of the rent from that date until yesterday. I would not let them do this to you and let them know that they can either give you your deposit and pro rate your rent and give you what your owed or you will do what is needed to get justice. Do not allow them to push you around and let someone live off of your rent for the time that they have been in that apt for the month of Jan. Good luck

If your lease didn't expire til the 31st, then there is no reason for them to go in and do anyting until the 1st. You are entitled to be there til the 31st 11:59 PM

Maybe it depends on the state, but on my last move, I moved out two weeks before the contract ended. On the 31st, I went back to the office to turn in my keys and release any obligation to the apartment.

Although, I don't see what you could actually gain from trying to fight it. It will be a loss of time.

It depends on if you turned in your keys or not. If you turned in your keys then you gave them possession. If you did not turn in your keys only moved your things out ~ then the apt. was still yours. However to prove that they went in before the 1st and paint, clean or whatever, will be very hard to prove. Also they will only owe you pro`rated rent for a couple of days. It may not be worth the time and very hard to prove.

No violation has occurred here but you might call a local attorney to clarify your state laws. If they do not return security deposit you can sue them in small claims court. cost you maybe $125 to file. I might try to get deposit from manager 1st.
They are aloud to deduct carpet cleaning and any damage you did to apt. They can charge you to clean it as well.
Did you sign a condition report when you rented the property to start out with??? if not that is a big no no on the landlords part. you should be able to get your money back if you didn't sign the condition report. The condition report proves the condition of apartment when you toke possession.
Without a signed condition report how can the landlord prove the carpets were clean when you moved in. So this being said I dont know if you left them a decent apartment or not.
I also don't know if you ever signed a condition report when you moved into the apt.
As for me I wouldn't bother trying to get back money cause my time is more valuable then the 500 security deposit or whatever it is. If you left them a decent apt and you never signed the condition report then you have a strong case to get the deposit back in court. It up to you if you decide to follow up.
Also in my state you have 21 days to give tenant a return of security deposit form as to why they kept your deposit or you can sue for double damages. I am in WI.
You must give them a forwarding address change of address right away would be a good thing. also return keys too. you might consider sending the keys and the change of address to them certified mail and deliver one personally too to there address. Proof of paperwork builds a better case in court. attorney can steer you in the right direction although they cost a mint for such small amounts of money being discussed.
State laws vary on this subject matter of landlord and tenant rights.
The last few weeks you paid rent for will not be returned to you by law. You generally must give a 30 day notice when you move and that could also void the return of your deposit depending again on your state law. I hate to be giving you half answers but each state has different laws.
If they come for damages on you remember about the condition report info I told you about!

Generally, the landlord, his agents and his workers have the right to enter to inspect, maintain and make any needed repairs AFTER giving proper written notice.

Since you did not reside in the apartment, you do not know if they gave you proper written notice. They may have posted it on the door, which is legit.
