Rental office said they didn't get my rent payment. I handed RIGHT to her!!!?


On 8/1/07 i paid the rent and water bill on in the form of 2 money orders that equaled to the amount due. On this Friday (yesterday) 8/17/07, a note is on my door saying theres a balance due and I haven't paid my rent this month. YES I HAVE! I have the bottom part of both money orders that saye "RECEIPT" and shows the purchase date and amounts. Besides that, I called the hotline listed on the money order that lets you check the status. I called and followed the phone prompts and the system says they were both cashed on 8/3/07- 2 days after I PERSOANALLY HANDED THEM TO HER. Whats the deal here? She said she'll evict if not paid by 8/20/07- Monday. I'm putting the copies of both money order receipts and a letter in the mail slot at the rent office and I told her I'll be over by 11am that morning to talk. I also left a message on the voice mail. Something is fishy. What do you suggest? I'm scared.

Don't worry. It probably is a mistake, but in the meantime they can't evict you without going through the court system. Most of the time it takes a month or two. If they havn't found the mistake by monday, contact the money order company again and get them to put a trace on the money orders to show who cashed them. The money order receipts are not proof enough for the rental office because someone can get money orders in the correct amount, fill out the receipt portion and then cash the money orders back in. The trace, if needed will show who cashed them, either the rental office or a employee with sticky fingers.

NO! don't put them in the mail slot, again HAND THEM TO HER! Ask for a signed receipt from her that you handed them to her. It could all just be a mistake and you'll get an apology.

Don't be scared, it's not like they can come put you on the street within hours. It's much more complicated than that.

You've done the right thing by showing her the receipts. She may have just screwed up her bookkeeping somewhere.

And relax--even if you get an eviction notice, it takes a long time, time enough to get it straightened out.

bottom line: did you get a receipt?
no receipt or canceled check, you have no proof of making that payment.

thats sounds like you have your basis covered. You did everything right = dont stress. Im sure it was someones mistake in the office and it cost misplaced. You can also give them the # to the hot line so they can call themselves. As long as you have paperwork to back you up they cant evict you.

If they dont accept your letter and receipts call a lawyer that would be a wrongful eviction in my opinion.

I suggest taking it to court if she saying she'll evict you but you'll win. I wouldnt live in a place that does that anyway maybe you should move.

Yanno, landlords are human too. Just this month I sent a letter to a tenant that she hadn't paid rent, she called me as she had paid. I told her I would check on it and she had indeed paid, I had just accidently overlooked it. So I called her back and apologized and let her know that I did find it.

Send a certified letter which she has to sign and that way you have proof you sent her a copy of the two receipts. She may not have thought about both payments made or she could have taken one for herself.

Get all of your correspondence with her together including any conversations by phone, email, letter and even the notice she gave you. Also write down dates and times, who you spoke with so that if she does take you to court you will be prepared. Don't be afraid because the judge will look at both sides and make his decision on who he believes.
