Rent Late - What to do?


Well, I was in desperate need of money, posted several questions on how to get the extra money quick....However, I was unable to obtain what I needed. My rent is now 2 days late. I will have to call the office and explain that I can't pay until 2 weeks from today. they have already left the "Notice to quit" letter on my door. Can they evict for being 2 weeks late?

If the rent is not received on the due date management must post and mail a 3-day to pay or quit notice. As they must also mail the notice you have a 5-7 day window to pay. The Landlord will then issue an eviction warning giving you a final date of when your file will likely go to the attorney's office. At that time, if you still have not paid, the attorney will begin filing a judgment and contact you with the appropriate paperwork and will offer to make arrangements to stop from going to court.

If you do not respond or pay, then the attorney files a judgment and you can elect to go before a judge. At that point you have one last chance to make payment arrangements or be evicted.

As you can see its a long process which takes more than a month. If the file goes to the attorney, you will be responsible to pay the attorneys fees, which at that point are about $500 or more on top of rent and late fees.

Call the office and try to make arrangements. They may be able to work with you. Evictions are expensive, and we'd rather get the money from you, rather than go to court and you not be able to pay anything at all and put up another unit to turn and re-rent.

Yes, you can be evicted for being two weeks late. Many property managers and landlords will try to work with you in that situation but it depends on your payment history, the rental market in your area and the attitude of the particular landlord or manager.

I think its time to go for a family or friend for a quick loan....

yes sadly rental places have the right to evict at any time as long as they give proper notice. my advice to you is to talk to your landlord and maybe make a parcel payment you never know they may be understanding if this is a first time offense.
