I rent an apt. and the gate to the pool has been broke for 3 mo. They never fixed it.? |
The other night a friend and I were in the pool and a man came in at 9 pm through the broken gate and tried to arttack us. He had no clothes on and was going to accost us. Thank god someone came by to help. If they would have fixed the gate he never would have gotten in. Does this make them responsible? We made a police report but he got away before they got here. I am very upset what should I do. I made a report with the office but a week later the gate is still broke. Any ideas? We pay a lot of rent to live here and now I do not feel safe. Contact your town or city Building Inspector. Tell them that you'll take them to court if they don't fix the problem. If they still don't, do take them to court. It sounds like the apartment owner is legally liable for any damage or trauma that you suffered because they were negligent due to the fact that they didn't provide adequate security or fix the broken gate. Talk to a lawyer about sending then a letter. I bet that they would notice if they were being threatened with a potential lawsuit. Watch how fast that they fix the gate after your lawyer send them a letter. Talk to your fellow renters and get a petitioned signed. You need to look carefully at your lease in regards to how to handle such matters, and yes they CAN be held liable if anything like that man attacking you happened because they failed to fix a broken lock, just be glad it's to the pool, and not your front door!!! Also contact the better business bureau in your area, report them for not fixing that lock. Get them a copy of the police report (especially if it MENTIONS the broken lock and any requests made to have it fixed) Either way, doesn't sound like the people who own the place are very concerned about fixing it, and your safety, I would look at finding a new place as soon as your lease is up (sooner if your lease says anything about it as a clause if a repair is not done, or if you think you can bluff your way out by saying you're considering suing them for not fixing the lock causing an unknown man to be able to enter and almost attack you, but I wouldn't go for the bluff if I were you). I hope they fix it, or you get to leave that place soon, I would never feel safe again! And our homes is where we SHOULD feel safe!!! |
