I have received a court date for eviction for non-payment of rent.I owe 2 months. My job downsized.?


I live and rent an apartment in Naperville,Illinois.Recently,my job cut my hours from 40 to 15 then downsized myself and 30 others.I let my management office know about this.My friend tried to help me and gave me a personal check to cover the money I owe and then said he had to go out of town for a month on business.The office told him how much I needed but when I brought the check over to office they said they can't accept a personal check,they need a cashiers check or money order BUT THEY DIDN'T TELL HIM OR MYSELF THAT ON PHONE. HE'S GONE OUT OF TOWN FOR A MONTH AND I CAN'T CONTACT HIM.I' ve have been served by sheriff to appear in court tomorrow.I'm so afraid that he's going to say me and my 15 year old daughter have to get out this week-end. Most people are telling me the judge will at least give you 30 days minimum. Is this true for Naperville, Illinois evictions?Has anybody been to court on a eviction in Naperville,Illinois? Somebody please help SOON! Thank-you guys in advance.

take the check with you to court, in all likelyhood, the judge will make the landord take it.

If you are under a lease, you are liable for payment. You can be evicted in most states after 30 days. Most landlords will work with you if you are trying. Some just don't care. Sounds like you have the latter. You will have to move, and you will have to pay. Be prepared with documentation when you go to court. The judge may cut down your payment amount and give you additional time to pay. But you will have to move.

i hate to tell you this, but your probably going to have to move. although you're situation is tough, the courtroom is dog eat dog and they are going to go easy on you. The judge will probably ask you why you didn't try to find another job that would pay more, or why you didn't get a loan. odds are, their going to try to put bullets through your entire case, however, i am pretty sure that you do in fact get 30 days.

Take it to your bank and cash it. You can also explain to the judge and he'll give you an extension. Good luck!

It sounds to me like the landlord just wants to get rid of you, due to concerns about paying the long term rent, which is why they are refusing to accept the current payment. If you talk to the judge about the situation, he/she may give you a break and force the landlord to accept the check, but I doubt it. You normally would get two to three weeks to leave the premises. paying rent stops the eviction. bring the check. if this is the truth and a friend of your wrote the check and is away on business for a month the judge will probably conclude that your friend has a cell phone. so bring the number. call your friend and tell him whats up and have him available for a call from the judges clerk. simple, but i think you are lying!
