Can a landlord in NYC take a security deposit for rent when a tenant has been legally released from a lease? |
I lived in an apartment for 3 weeks before asking to be released from it after I was assaulted in the building. The office manager agreed and wrote a document saying my guarentors were legally released from the lease as of that date. He said I would be getting the security deposit back in full unless by some chance I had done major damage to the unit (which was not done). Now the corporate office is saying that even though I was released they are taking my security deposit to pay for another's months rent because no one moved into my unit until Nov. 1st. Do they have any legal standing for this argument? Get a lawyer. It's a NYC rental law issue. Depending on what is in your lease agreement. If it is not explicitly stated either way in the agreement contact a lawyer YOU CAN BE RELEASED FROM YOU ONE YEAR LEASE ECT BUT YES THEY CAN TAKE THAT SCTY DEPOSIT SOLEY BECAUSE YOU DIDN'T MEET BASIC TENANT AGREEMENT.. |
